Prison officials change policy after a state senator complains about a menu request

Texas death row inmates will no longer be permitted to choose the menu for their last meal.

The decision came after state Sen. John Whitmire took issue with the meal ordered by Lawrence Russell Brewer, who was executed Wednesday for the infamous dragging death of James Byrd Jr., a black man from East Texas.

Whitmire said he has always disapproved of catering to inmates, but this case seemed especially outrageous. On Thursday, he called the director of the Texas Department of Criminal Justice and followed up with a letter, recounting Brewer's meal choice of two chicken fried steaks, a triple meat bacon cheeseburger, a cheese omelet, a large bowl of fried okra, three fajitas, a pint of Blue Bell ice cream, and a pound of barbecue with a half loaf of white bread.

TDCJ Executive Director Brad Livingston responded: "I believe Senator Whitmire's concerns regarding the practice of allowing death row offenders to choose their last meal are valid. Effective immediately, no such accommodations will be made. They will receive the same meal served to other offenders on the unit."

Whitmire, chairman of the state Senate Criminal Justice Committee, said he's not sure when the long-standing tradition of catering to an inmate's last meal request began or how many other states with capital punishment follow the same practice.

The Death Penalty Information Center, a Washington-based anti-capital punishment organization that collects execution statistics, told The Associated Press it had no information on final meals.

Troy Davis, executed in Georgia a few hours after Brewer, reportedly declined a last meal.

Journalists have been documenting final meals for decades. Serial killer John Wayne Gacy, executed in Illinois on May 10, 1994, for the rape and murders of 33 young men and boys, ordered fried shrimp, Kentucky Fried Chicken, French fries and a pound of strawberries. Timothy McVeigh requested two pints of mint-chocolate chip ice cream before his execution on June 11, 2001, in Indiana, for the 1995 Oklahoma City bombing, which killed 167 people and injured 684.

Whitmire said he's satisfied with the policy change, which will affect three inmates scheduled for death this year. Overall, Texas has 308 inmates awaiting execution.

"No death-row inmate prior to execution should be catered to," he said. "It's just common sense."

As for Brewer's last meal, Whitmire said it was an act of manipulation. Prison officials reported he ate none of it.

I think that when you are being executed that is your punishment. In my mind these people are being put to death, what could a reasonable last meal really harm. Its kind of a humane act on top of a viscious act on our part as a society. I do not really know if I am for or against the death penalty, but that is not the question here. They are obviously doing it to be cruel though. Its not like a judge is going to say I sentence you to death, with out a last meal! When a prisoner gets it , it is kind of just something to help let them not have a heart attack before the end! Another reason I say it is for cruelty is because they are not trying to balance any budget! Texas is one of the few states that is not suffering to bad of a recesssion, and lets be honest, even if they are the state that executes the most people, how much do a few reasonably priced last meals really cost?

Just to be sure you understood what this is about correctly, they wanna eleminate the special last meals (i.e. death row inmates being able to choose what they eat as a last meal) and give them the standard prison meal. They don't wanna eliminate the last meal alltogether.

That's why you don't mess with Texas. They probably whisper in your ear that you were adopted and that God hates you, right before they kill you, too! Texas is the Wolverine of the United States. Their the best there is at what they do....but what they do isn't very nice.



Sounds about right. That meal is literally money, time, etc. down the drain.

I was going to make a thread during the Troy Davis controversy but I'll just say it here: I wonder what goes through the mind of a person sentenced to death. How can you walk willingly into a room where people are going to watch you die? They'd have to drug me, break my neck, or prepare for the fight of my life.

3 dollars times 17 a year equals what? I doubt it is breaking the bank. They got there punishment, lets not make it worse now.

Just try to imagine what it would be like if you were in that situation. Take into consideration everything though: the fact that you killed someone, the fact that you spent the last 20 years waiting to be executed etc. I've personalyl always foud it disgusting that these executions are 'public'. As if it was some sort of show for people's aumsement. That's what would bother me most honestly.

If the person really cared, let's open up a special complaints office where they can bring up their grieviances for up to 3 weeks after the event.

make the process more efficient between sentencing and death and you dont have to worry about the cost of the meal.
